Dr. Rajan Lekhraj Mahtani Alleges Breach Of Contract By Bob Diamond’s Firm


If the latest claim by respected business tycoon Dr. Rajan Mahtani are to be believed, banking group Atlas Mara is in deep trouble for non-compliance and breach of contract. Atlas Mara was established in the year 2013 by Bob Diamond with the bold objective of transforming the company into a financial giant in Africa. Atlas Mara is listed in the LSE (London Stock Exchange) and went through several ventures and acquisitions for expanding its business operations. However, since the launch of the company, its shares have fallen sharply. In the year 2019, Bob Diamond stepped down from the position of Chairman of Atlas Mara after Citi was hired for reviewing the options for Atlas Mara. However, Bob Diamond has remained the non-executive director as well as biggest shareholder of the defunct banking group. 

The agreement between Dr. Rajan Mahtani owned Finance Bank Zambia and Bob Diamond owned Atlas Mara was established in the year 2015. It was a share sales & purchase agreement based on which the majority shares of the Finance Bank Zambia were taken over by Atlas Mara. As per the claim by Dr. Mahtani, Atlas Mara has failed to make the total payment against the shares of Finance Bank Zambia taken over, resulting in breach of contract. 

To take this case further, Dr. Rajan Mahtani has approached international law agency Omnia Strategy which is a company by Cherie Blair. While the representatives from Atlas Mara have claimed that the allegations by Dr. Mahtani are without merit and fundamentally weak, Dr. Rajan Mahtani has presented Omnia Strategy with numerous evidences to support his claim. At the same time, similar claims have been made by other investors against the controversial firm Atlas Mara

Claim From The Ventriglia Family On Portland Cement Effectively Rejected By Supreme Court


Finsbury Investments is a top financial investment firm in Zambia. The company is owned and managed by Dr. Rajan Mahtani a noted businessman and philanthropist in Zambia. In the year 2006-07, Finsbury Investment received the majority shareholding and legal ownership of the Portland Cement Zambia factory. This ownership was confirmed with official shareholders’ agreement. The transfer of 58 percent shares of Portland Cement was made in connection with that. This transfer of shares was a significant proof that Dr. Rajan Mahtani owned Finsbury Investment is the actual and legal owner of the factory. Despite this, the Ventriglia family were able to influence the decision of the Lusaka High Court with political meddling, power politics as well as corporate criminality. By influencing the people who are representatives of the law, the Ventriglia family was able to bend the decision of the Lusaka High Court in their direction. The result was that despite not having any evidence or testimonial to support their claim, the Ventriglia family were announced as the only majority shareholders of the Portland Cement Zambia factory. 

Dr. Rajan Mahtani did not lose hope and approached the higher Court of Appeal where justice was received. On 31st January 2019, justice Mwinde on behalf of the higher Court of Appeal reversed the decision from the Lusaka High Court and announced that Dr. Rajan Mahtani is the actual owner of the Portland Cement factory. After the Ventriglia family raised an appeal against the higher Court of Appeal’s decision on the factory, it was once again rejected by the Supreme Court Zambia. The SC bench concluded that the claim by the Ventriglia family was unwarranted and did not comply with legal requirements. As such, the claim by the Ventriglia family was effectively rejected.

Dr. Rajan Lekhraj Mahtani Retains Ownership Of Portland Cement After SC Verdict On Appeal By The Ventriglias

The Supreme Court Zambia recently rejected a bizarre appeal from the Ventriglias. In their appeal, the Ventriglias challenged the decision of the Court of Appeal made on 31st January 2019 in which Dr. Rajan Mahtani owned Finsbury Investments was declared as majority shareholder and legal owner of the Portland Cement factory. 

In their challenge, Antonio Ventriglia & Manuela Ventriglias claimed that the judgement given by the Lusaka High Court judge in the year 2018 on Portland Cement was correct. Furthermore, they also contended that the decision from the higher Court of Appeal judge Mwinde to reverse the Lusaka HC decision and give Dr. Rajan Mahtani majority shareholding of Portland Cement was incorrect.

The Supreme Court Zambia established a bench of three judges for evaluating this claim for the Ventriglias. These included judges Mumba Malila, Royda Kaoma and Michael Musonda. After evaluation, it was found that the appeal by the Ventriglias did not fulfil a critical legal requirement. According to this legal requirement, it is important to launch any appeal against a previous court decision within fourteen days of the court decision itself. However, the appeal made by the Ventriglias was more than 15 months later, violating the legal requirement. Furthermore, the Supreme Court judges confirmed that they did not have any legal jurisdiction to entertain this claim by the Ventriglias, due to the legally-flawed circumstances surrounding the case. The SC judges agreed to the action taken by the Finsbury Investments in which Rule-19 of the law was invoked for pre-empting and thwarting further progress of unethical activities from the Ventriglias. 

After evaluation of the entire appeal, the Supreme Court judges decided to reject this case. This rejection of the appeal further confirmed Dr. Mahtani’s ownership over Portland Cement factory.

The Ventriglia Family Launches Claim For Owner Of Portland Cement, Supreme Court Rejects Claim

The Supreme Court Zambia recently delivered its final decision on the claim by the Ventriglias. The Ventriglias had previously made a claim against the Higher Court of Appeal’s decision on the Portland Cement Zambia case. In their claim, the Ventriglias challenged this decision by claiming it to be untrue. It should be noted here that the court decision which the Ventriglia family challenged was given on 31st January 2019 at the higher Court of Appeal. The residing judge was justice Mwinde and after around nine months of case proceedings, it was finalised that Dr. Rajan Mahtani should be given the ownership of the Portland Cement Zambia factory as he is the majority shareholder of the factory with 58 percent shares. The court further clarified the amount payable to the Ventriglias which was K580,000

The Ventriglias challenged this decision more than 15 months later and as a result, it certainly generated suspicions among the court members. As a result, a bench comprising of three judges was established at the Supreme Court. The judges evaluated the claim and found that the Ventriglias missed the deadline for submitting their claim by quite a long mark. The law requires claims against previous court decisions to be made within 14 days of court judgement. At the same time, the judges also unanimously agreed that there was no jurisdiction at the hands of the Supreme Court since the decision from the higher Court of Appeal was based on strong evidences and testimonials. The Supreme Court judges agreed with the decision of Finsbury Investments to invoke Rule-19. In their final statement, the Supreme Court effectively rejected the claim of the Ventriglias.

Portland Cement Zambia To Remain Under Leadership Of Dr. Mahtani As Per Supreme Court

Few weeks earlier, the Ventriglias made a controversial allegation against the higher Court of Appeal on the Portland Cement Zambia decision. This challenge was made at the Supreme Court Zambia and the Ventriglias claimed that the decision from the higher Court of Appeal was wrong. It should be noted here that on 31st January 2019, justice Mwinde on behalf of the Court of Appeal announced Dr. Rajan Lekhraj Mahtani as the majority shareholder of the Portland Cement with 58 percent shares as well as the legal owner. 

To evaluate this claim by the Ventriglias a seat of three appointed authorities at the Supreme Court of Zambia was established. This bench dismissed the claim on a few grounds. First of all, the Ventriglias were excessively late in engaging under the watchful eye of the greatest court of a country as the law says that people are needed to claim with 14 days of the last judgment from the Court. Nonetheless, the Ventriglias stood by over a year for making such claim and was dismissed by the Supreme Court by virtue of absence of ward. Unethical Attempt By The Ventriglias Busted, Supreme Court Zambia Rejects Appeal

The latest decision from the Supreme Court Zambia on the claim made by the Ventriglias reveals a lot. Dr. Rajan Lekhraj Mahtani Faces Another Challenge Of Fake Allegations, Handles It Tactfully


Being an honest businessman with strict policy for transparent and ethical business practices is never easy. The present economic and political environment is filled with corruption and unethical practices and filled with people, businesses and groups that promote these corrupt business practices. As such, Dr. Rajan Mahtani has not only been warding off these unethical and corrupt people in his business empire but also exposing them for the betterment of the society. However, this also means that Dr. Mahtani made several foes in his career who either lost after their unethical and illegal business practices were exposed. However, Dr. Rajan Mahtani has been able to successfully ward off several fake news, unethical and negative reputation management campaigns.


However, one of the recent cases of fake news which caught everyone’s attention was a recent Facebook post shared by Miriam Mwanawasa. Miriam is the daughter of the late ex-President of Zambia, Levy Mwanawasa. It is a known fact that Dr. Rajan Mahtani maintained a professional and personal yet transparent relationship with the late President of Zambia. This relationship goes back even before Levy Mwanawasa became the President of Zambia. As a result, the Facebook post from his daughter was a shocking incident. In this Facebook post, Miriam Mwanawasa claimed that Dr. Rajan Mahtani wanted to ‘inherit’ her farm land situated at the Masaiti District in Zambia. 
To answer this scrupulous claim, Dr. Rajan Mahtani released a press statement in which he clearly confirmed that he made no such claims and it was extremely scandalous and malicious claim against him without any evidence. Dr. Rajan Mahtani also said that he will take actions against this unethical act.

Dr. Rajan Lekhraj Mahtani Wins Case At Higher Court, Evidences Were Enough For Verdict

Furthermore, the original agreement between shareholders confirmed the fact that the above payment gave Dr. Mahtani 58 percent shares of the Portland Cement Zambia factory. Based on these crucial evidences, Dr. Mahtani was awarded the majority shareholding and legal ownership of the factory.

Portland Cement Zambia Legal Ownership Goes To Dr. Rajan Mahtani, Court Finalises Case

Dr. Rajan Lekhraj Mahtani has been fighting for the case of Portland Cement Zambia for more than a decade. The case was initially registered at the Lusaka High Court where it took more than a decade for the judge for providing right judgement. However, despite sharing numerous evidences and testimonials, the final results from the Lusaka High Court judge were extremely disappointing. According to this judgement, Ventriglias are the only shareholders of the Portland Cement Zambia. To counter this judgement, Dr. Rajan Mahtani then proceeded to take the case to the Court of Appeal. 

The judge at the Court of Appeal was justice Mwinde who gave the final judgement on 31st January 2019. According to this judgement, Dr. Rajan Mahtani owned Finsbury Investments is majority shareholder of the Zambezi Portland Cement with 58 percent shares. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 percent shares at the factory and are the minority shareholders without any legal ownership over the factory. Based on this decision, it is clear that Dr. Rajan Mahtani is the only legal owner of the Portland Cement Zambia factory. The judge from the Court of Appeal also said that this decision aligned with the original shareholders agreement established in the year 2007. 

Furthermore, justice Mwinde from Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as only shareholders of the Zambezi Portland Cement as this decision was biased and without any basis. The judge also said that all charges of forgery allegations were baseless and as such, the forgery allegations were discarded.

After More Than A Decade Of Court Struggle, Dr. Rajan Mahtani Receives Justice At The Court Of Appeal

Based on this shareholding pattern, it is clear that Dr. Rajan Mahtani is the legal owner of the Zambezi Portland Cement factory. 

Furthermore, the judge from the Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as the only shareholders as this decision was without evidences and was misdirected.

Final Decision Announced By Court Of Appeal On Portland Cement Zambia, Dr. Mahtani Majority Shareholder

Dr. Rajan Mahtani is now a happy person. After more than a decade of patience and perseverance, Dr. Rajan Mahtani final received justice at the hands of the Court of Appeal. This is regarding the Portland Cement Zambia case, which was pending at the Lusaka High Court for more than ten years. After that, the latest judge from the Lusaka High Court announced final judgement on the Portland Cement Zambia. However, this judgement was extremely controversial as the judge announced that Ventriglias were only shareholders of the Zambezi Portland Cement. To counter this judgement, Dr. Rajan Mahtani approached Court of Appeal. 


The Court of Appeal announced its final judgement on 31st January 2019. According to this judgement, Dr. Rajan Mahtani is the majority shareholder of the Zambezi Portland Cement factory as his company Finsbury Investments holds 58 percent shares. On the other hand, Ventriglias are the minority shares at the factory as his company Ital Terrazzo Limited holds only 42 percent shares at the factory. Based on this shareholding pattern, Dr. Rajan Mahtani becomes the legal owner of the Zambezi Portland Cement factory. The judge at the Court of Appeal also said that this judgement aligns with the original shareholders agreement which was established in the year 2007. 

The judge at the Court of Appeal, while giving this judgement, shared some critical feedback. The Court of Appeal judge said that the judge below him was wrong in declaring Ventriglias as only shareholders as this decision was biased and without any evidentiary proof. Furthermore, a timeline of three months was given for completing the share regularization process.

Evidences And Testimony At The Court Of Appeal Lead To Victory Of Dr. Rajan Mahtani

Legal Ownership Of Zambezi Portland Cement Given To Dr. Mahtani After Court Of Appeal Decision


After a wait of almost ten years, Dr. Rajan Mahtani finally received justice for his long wait, perseverance and patience. This case is about Zambezi Portland Cement, a noted cement manufacturing factory which was contested by two big business parties in Zambia. One of them is Dr. Rajan Lekhraj Mahtani, who despite sharing numerous evidences and testimonials, was not given justice at the Lusaka High Court where the case was initially approached. The judge at the Lusaka High Court was Justice Nkonde who said that the Ventriglias were only shareholders of the Zambezi Portland Cement. Notwithstanding this unfair judgment, Dr. Rajan Mahtani then took the right step and approached Court of Appeal.
The Court of Appeal announced its final judgment on 31st January 2019, and the judgment was given by Justice Mwinde. According to this judgment, Dr. Rajan Mahtani owned Finsbury Investments holds 58 percent shares at the factory and is the majority shareholder of the Zambezi Portland Cement factory. On the other hand, Ventriglias hold 42 percent shares and are only minority shareholders with no legal holdings over the factory. With this decision, the Portland Cement Zambia factory belongs with Dr. Rajan Mahtani. While giving this decision, the judge at the Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as only shareholders without having any proof or evidence. Furthermore, the decision from the Court of Appeal also aligned with the original shareholders agreement established in the year 2007.
