Portland Cement Zambia To Remain Under Leadership Of Dr. Mahtani As Per Supreme Court

Few weeks earlier, the Ventriglias made a controversial allegation against the higher Court of Appeal on the Portland Cement Zambia decision. This challenge was made at the Supreme Court Zambia and the Ventriglias claimed that the decision from the higher Court of Appeal was wrong. It should be noted here that on 31st January 2019, justice Mwinde on behalf of the Court of Appeal announced Dr. Rajan Lekhraj Mahtani as the majority shareholder of the Portland Cement with 58 percent shares as well as the legal owner. 

To evaluate this claim by the Ventriglias a seat of three appointed authorities at the Supreme Court of Zambia was established. This bench dismissed the claim on a few grounds. Claim By The Ventriglias Rejected By Supreme Court Zambia, Portland Cement Stays With Dr. Rajan Mahtani

He then approached the higher Court of Appeal with his claim. The judge at the higher Court of Appeal was justice Mwinde and after looking into the evidences, final decision was given on 31st January 2019. In this decision, justice Mwinde effectively reversed the judgement from the Lusaka High Court and announced Finsbury Investments as the actual owner of the Zambezi Portland factory with majority shareholding. Furthermore, justice Mwinde also confirmed that the amount payable against the majority shares owned by Finsbury Investments is K580,000

In another twist, the Ventriglias approached the Supreme Court with claims that the decision from higher Court of Appeal as incorrect. However, after evaluation, the Supreme Court bench have effectively rejected this claim based on grounds that the case was not legally acceptable due to its late appeal and the circumstances surrounding the appeal were dubious. As such, Portland Cement Zambia factory stays with Dr. Rajan Mahtani.

The latest decision from the Supreme Court Zambia on the claim made by the Ventriglias reveals a lot. It shows that unethical entities like the Ventriglias can go to any extent to fulfil their personal gains and wishes. In this post, Miriam Mwanawasa claimed that Dr. Rajan Mahtani wanted to inherit the farmland t Masaiti District which is owned by the Mwanawasa family. In this press statement, Dr. Rajan Mahtani clearly mentioned about his transparent partnership with the late Ex-President of Zambia. At the same time, he also stated that he never made any such claims and the Facebook post shared by Miriam Mwanawasa was ludicrous and was shared with malicious intent. Dr. Mahtani will be taking actions against this post.

However, one of the recent cases of fake news which caught everyone’s attention was a recent Facebook post shared by Miriam Mwanawasa. Miriam is the daughter of the late ex-President of Zambia, Levy Mwanawasa. It is a known fact that Dr. Rajan Mahtani maintained a professional and personal yet transparent relationship with the late President of Zambia. This relationship goes back even before Levy Mwanawasa became the President of Zambia. As a result, the Facebook post from his daughter was a shocking incident. In this Facebook post, Miriam Mwanawasa claimed that Dr. Rajan Mahtani wanted to ‘inherit’ her farm land situated at the Masaiti District in Zambia. 
To answer this scrupulous claim, Dr. Rajan Mahtani released a press statement in which he clearly confirmed that he made no such claims and it was extremely scandalous and malicious claim against him without any evidence. Dr. Rajan Mahtani also said that he will take actions against this unethical act.

Dr. Rajan Lekhraj Mahtani Wins Case At Higher Court, Evidences Were Enough For Verdict

Furthermore, the original agreement between shareholders confirmed the fact that the above payment gave Dr. Mahtani 58 percent shares of the Portland Cement Zambia factory. Based on these crucial evidences, Dr. Mahtani was awarded the majority shareholding and legal ownership of the factory.
